1. About Terms and Conditions
 

These Terms and Conditions ("Agreement") govern your use of the ApnaJagah platform. By accessing or using our services, you agree to be bound by this Agreement, which is in accordance with the Indian Contract Act, 1872, and other applicable laws.


2. User Agreement
 

Under Section 10 of the Indian Contract Act, 1872, a valid contract requires free consent, lawful consideration, and lawful object. By registering on our platform, users affirm that they are competent to contract as per Section 11 of the Act.      


3. Amendment to the User Agreement
 

ApnaJagah reserves the right to modify this Agreement at any time. Changes will be effective upon posting on the website. Continued use of the platform constitutes acceptance of the revised terms.


4. Important Disclaimers
 

ApnaJagah acts as an intermediary platform facilitating connections between buyers and sellers. We do not guarantee the accuracy of listings or the completion of transactions. Users are advised to conduct due diligence before entering into any agreement.
 

5. Electronic Communications
 

By using our platform, you consent to receive communications electronically. This complies with the Information Technology Act, 2000, which recognizes electronic records and digital signatures.
 

6. Subscription Eligibility
 

Users must be at least 18 years old and legally capable of entering into contracts. By registering, you confirm your eligibility.


7. Subscription Benefits
 

ApnaJagah offers various subscription plans for enhanced visibility and services. Details of each plan, including duration and benefits, are available on our website.
 

8. Your Account and Registration Obligations
 

Users are responsible for maintaining the confidentiality of their account information. Any activity under your account is your responsibility. Notify us immediately of any unauthorized use.


9. Fees & Services
 

ApnaJagah charges fees for certain services, such as property listings and property visits. All fees are non-refundable once the service is rendered. Details are provided at the time of service selection.


10. Taxes
 

Users are responsible for any applicable taxes related to transactions conducted through our platform. ApnaJagah complies with the Goods and Services Tax (GST) regulations as per the Central Goods and Services Tax Act, 2017.


11. Commission
 

ApnaJagah charges a 10% commission separately from both the buyer and the seller.
The 10% commission must be paid before the signing of any property agreement between the buyer and the seller.
The commission amount is calculated based on the final agreed property value.
Failure to pay the commission in advance may result in cancellation of the deal facilitation.


12. Use of the Website
 

Users agree to use the website for lawful purposes only. Prohibited activities include:

*Posting false or misleading information.

*Infringing on intellectual property rights.

*Engaging in fraudulent activities.

*Violation may result in account suspension or termination.


13. Platform for Communication
 

ApnaJagah provides a platform for users to communicate. We are not a party to any transaction between users and do not guarantee the quality or legality of listings.
 

14. Privacy

Our Privacy Policy outlines how we collect, use, and protect user information. By using our services, you consent to our data practices in compliance with the Information Technology Act, 2000.
 

15.Payment Terms 
A) FOR BUYERS
Buyers must make payments directly to sellers for the property value, separate from the ApnaJagah commission.
10% Commission must be paid directly to ApnaJagah at the time of signing agreement for the deal proceedings, by bank transfer, UPI, cheque, or any officially communicated method.
Commission paid is non-refundable once the property agreement is signed or if the customer cancels after agreement finalization.

B) FOR SELLERS
Sellers must accept payments directly from the buyers for the property value, separate from the ApnaJagah commission.
10% Commission must be paid directly to ApnaJagah at the time of signing agreement for the deal proceedings, by bank transfer, UPI, cheque, or any officially communicated method.
Commission paid is non-refundable once the property agreement is signed or if the customer cancels after agreement finalization.
 

16. Breach

If you breach this Agreement, ApnaJagah may take appropriate actions, including account suspension, termination, and legal proceedings under applicable laws.
 

17. Selling

Sellers must ensure that listings are accurate and not misleading. All properties listed must be legally owned or authorized for sale. Sellers are responsible for complying with applicable laws and regulations.All property prices listed on our website are final as quoted by the seller unless stated otherwise.
 

18. Buying

Buyers are responsible for conducting due diligence before purchasing properties. ApnaJagah does not guarantee the quality or legality of listed properties.
 

19. Renting

Rental listings must be accurate and comply with local rental laws. Landlords and tenants are responsible for fulfilling their respective obligations under rental agreements.
 

20. ApnaJagah Brand Protection Policy

Unauthorized use of the ApnaJagah brand, logo, or trademarks is prohibited. We reserve the right to take legal action against infringement.
 

21. Limitations of Liability

ApnaJagah is not liable for any indirect, incidental, or consequential damages arising from the use of our platform. Our liability is limited to the maximum extent permitted by law.
 

22. Indemnity

Users agree to indemnify and hold ApnaJagah harmless from any claims, damages, or expenses arising from their use of the platform or violation of this Agreement.
 

23. General

This Agreement constitutes the entire understanding between the user and ApnaJagah. If any provision is found to be unenforceable, the remaining provisions will remain in effect.

25. Governing Law

This Agreement is governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Baleshwar, Odisha.
 

26. Arbitration

Disputes will be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration will be conducted in Baleshwar, Odisha.
 

27. E-Coupons

E-coupons provided by ApnaJagah are subject to specific terms and conditions. They are non-transferable and cannot be redeemed for cash.
 

28. Other Terms and Conditions

Additional terms may apply to specific services or promotions. Users are advised to review these terms before participating.
 

29. Disclaimer

ApnaJagah provides services "as is" without warranties of any kind. We do not guarantee the accuracy or completeness of listings.
 

30. ApnaJagah.com - Grievance Officer

In compliance with the Information Technology Act, 2000, the Grievance Officer for ApnaJagah is: MR BRAJ KISHORE ROUT.
